Plexcom reserves the right to make changes to the Terms Of Service from time to time at its sole discretion. Customer and or Users are soley responsible for complying with the Terms of any such modified Terms of Service. Any amendments made to these Terms of Service will be considered effective ten (10) days after the amendments are posted on the site.
The Terms Of Service ("Terms") describes actions by Users that are prohibited by Plexcom. "Customer" means any user of the Internet related services ("Services") that are provided by Plexcom pursuant to the Service Order ("SOA") and Service Level Agreement ("SLA") (which Customer must accept as a condition to recieving any services from Plexcom). Customer acknowledges and agrees that these Terms may be revised from time to time by Plexcom at its discretion, with any such modifications becoming effective 10 days after the amendments are posted to http://www.plexcom.net/legal_terms.html. In addition all Customers must comply with the then-current industry standard acceptable use policy set forth at http://www.ipservices.att.com/policy/html, or such other acceptable use policy web sites as set forth from time to time by Plexcom. To the extent these third-party acceptable use policies conflict with Plexcom's Terms, Plexcom's Terms will prevail. Plexcom may at its sole discretion determine whether a Customer is in violation of these Terms. As specified below, Plexcom believes that illegal usage abusive usage and/ or use of Services to interfere with others' enjoyment fo the Services is unacceptable. In the event you believe that you have been a vicitm of abusive or illegal usage of Services, please contact abuse@plexcom.net.
Terms Of Service
Customer agrees to comply with, and ensure that all of its employees, consultants, agents and other representatives that use the Service comply with, all laws, rules and regulations governing use of the Internet and e-mail transmissions. Plexcom prohibits use of its Services in any way that: (i) is unlawful; (ii) interferes with use of the Network or the Internet by any other person or entity; (iii) infringes the intellectual property rights or privacy rights of any other person or entity; (iv) results in the publication using the Service of threatening or offensive content or material, including without limitation, harassing, obscene, indecent, pornographic, hateful, racist, defamatory or libelous content or material; (v) constitutes Spam/E-mail/Usenet abuse, including, without limitation, sending “spam,” “junk e-mail,” “bulk e-mail,” or “unsolicited commercial e-mail;” or (vi) presents security or privacy risks, including, without limitation, interfering with or gaining unauthorized access to or otherwise violating the security of the Network or any other person or entity’s server, e-mail accounts, or data.
Customer hereby agrees to indemnify and hold harmless Plexcom and its officers, directors, shareholders, employees, representatives and agents, and their respective affiliates, successors and assigns (collectively, the “Indemnitees”), from and against any loss, liability, claim, damage, cost, expense (including reasonable attorney’s fees, disbursements and other charges of counsel), or diminution in value suffered by any Indemnitee, resulting or arising from or in connection with any breach of the SOA & SLA, including, without limitation, by Customer or any of its employees, consultants, agents or other representatives.
Remedies
Violation of these Terms may result in civil or criminal liability, and Plexcom may, in addition to any remedy that it may have at law or in equity, terminate permission for the Customer to use the Services and charge Customer any applicable cancellation or termination fee. In addition, Plexcom may investigate incidents that are contrary to these Terms and provide requested information to third parties who have provided notice to Plexcom stating that they have been harmed by a Customer's failure to abide by these Terms or the Terms and policies listed above. Plexcom's failure to enforce these Terms in every instance in which might have application does not amount to a waiver of Plexcom's rights.
